1. About These Terms

These Terms of Service ("Terms") govern your use of Moments in Vine ("we," "our," or "us"), a wine collection management service available at momentsinvine.com (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. The Service

Moments in Vine helps wine collectors manage their collection and know when to open their bottles. The Service includes:

  • Tracking your wine collection, drinking windows, and tasting notes
  • Receiving personalised email reminders when wines are ready to drink
  • Importing and exporting your collection data
  • Viewing collection statistics and insights

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription tiers in future, with reasonable notice.

We provide the Service on a reasonable-efforts basis. We do not guarantee uninterrupted or error-free availability, though we take reasonable steps to maintain reliability.

3. Eligibility

You must be at least 18 years old to use the Service. This is an alcohol-related product and is not intended for anyone under the legal drinking age in their jurisdiction.

By creating an account, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

4. Your Account

4.1 Registration

You must provide a valid email address and create a password to use the Service. You must confirm your email address before you can sign in.

4.2 Security

You are responsible for keeping your login credentials secure. You must not share your account or let others access it. If you believe your account has been compromised, contact us immediately at hello@momentsinvine.com.

4.3 Accuracy

You must keep your account information accurate and up to date.

5. Your Content

5.1 Ownership

You retain ownership of all content you submit to the Service, including your wine collection data, tasting notes, ratings, and any other information you provide ("Your Content").

5.2 Licence to Us

By using the Service, you grant us a limited, non-exclusive, worldwide licence to host, store, process, and display Your Content for the purpose of operating and improving the Service. This licence ends when you delete Your Content or close your account (subject to our data retention practices described in our Privacy Policy).

5.3 De-identified Data

We may use anonymised or de-identified data derived from use of the Service for product improvement, analytics, and research. De-identified data has all identifying information removed and cannot reasonably be linked back to you.

5.4 Data Portability

You may export your wine collection data at any time using the export feature within the Service.

6. Acceptable Use

You agree not to:

  • Provide false or misleading account information
  • Access or attempt to access another user's account
  • Use automated systems (bots, scrapers) to access the Service without our permission
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any unlawful purpose
  • Attempt to circumvent any security measures or access controls
  • Upload malicious files or content designed to exploit the Service

We reserve the right to suspend or terminate your account if you breach these Terms.

7. File Uploads

You may upload files to the Service (for example, to import your wine collection). When you upload files:

  • You are responsible for the content and accuracy of uploaded data
  • Files must not contain malicious code, scripts, or executable content
  • Uploads are subject to size and format limits as described in the Service

8. Email Communications

8.1 Service Emails

By creating an account, you will receive essential service communications such as email confirmation, password reset, and account-related notices. These cannot be opted out of while your account is active.

8.2 Reminder Emails

If you opt in to email reminders, we will send you periodic emails about wines in your collection that are ready to drink. You can opt out of reminder emails at any time through your account settings.

9. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Moments in Vine and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.

10. Account Closure

10.1 By You

You may deactivate your account at any time through your account settings. When you deactivate:

  • Your account will be immediately inaccessible
  • You will have a 30-day grace period during which reactivation may be possible by contacting us
  • After the grace period, your account data will be irreversibly anonymised and your account cannot be recovered

10.2 By Us

We may suspend or terminate your account if you breach these Terms, engage in fraudulent behaviour, or if we discontinue the Service. Where reasonably practicable, we will provide notice before doing so. Unless prohibited by law or where doing so would compromise the security of the Service or other users, we will make reasonable efforts to provide you with an opportunity to export your data before termination takes effect.

10.3 Effect of Closure

Upon account closure, your right to use the Service ends immediately. We recommend exporting your data before deactivating your account. Sections of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

11. Disclaimers

The Service is provided "as is" and "as available." To the extent permitted by applicable law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular:

  • Wine drinking window suggestions (whether user-entered or system-generated) are informational only and not professional advice. Always use your own judgement when deciding when to open a bottle.
  • We do not guarantee the accuracy of any predictions, recommendations, or derived data.
  • We rely on third-party service providers for hosting, email delivery, and other infrastructure. We are not responsible for their outages or failures.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under English law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of (or inability to use) the Service.
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed one hundred pounds sterling (GBP 100).

If you are a consumer resident in the United Kingdom, these limitations apply only to the extent permitted by the Consumer Rights Act 2015 and other applicable consumer protection legislation.

13. Changes to the Service

We may modify, update, or discontinue features of the Service at any time. Where changes materially reduce the functionality available to you, we will provide reasonable advance notice via email or through the Service.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after such notification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and deactivate your account.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in the European Economic Area, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence.

16. Dispute Resolution

If you have a concern, please contact us at hello@momentsinvine.com. We will make reasonable efforts to resolve disputes informally before either party pursues formal proceedings.

17. General

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moments in Vine regarding the Service.
  • No waiver: Our failure to enforce any provision does not waive our right to do so in the future.
  • Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to a successor in the event of a merger, acquisition, or sale of assets, with notice to you.
